1. Scope

This Privacy Policy (“Policy”) explains how Eqservers LLC (“Eqservers,” “we,” “us,” “our”) collects, uses, discloses, and safeguards information in connection with our websites and portals (the “Site”) and our dedicated/bare-metal and related services (the “Services”). If this Policy conflicts with a signed agreement or data protection addendum (“DPA”), that contract controls to the extent of the conflict. By using the Site or Services, you acknowledge this Policy.


2. Information We Collect

2.1 Information You Provide

  • Account & Billing: Name, company, role, email, phone, billing/postal address, tax/VAT IDs, and payment details processed via PCI-compliant providers.
  • Orders & Provisioning: Service selections and identifiers needed to provision networking (for example, ASN, LOA references, IRR/RPKI references).
  • Support & Communications: Tickets, emails, attachments, and any logs or data you choose to share.

2.2 Information Collected Automatically

  • Device/Usage Data: IP address, device/browser/OS, pages viewed, referrers, timestamps, and session metadata.
  • Service Telemetry: Network/device heartbeat, interface counters, limited flow/traffic metadata necessary for operations, capacity, security, and billing (no content inspection). Such data is retained consistent with our legal, regulatory, security, and business-record obligations and may be exempt from certain access or deletion requests where permitted by applicable law.
  • Cookies/Similar Tech: Session and preference cookies; analytics cookies to understand Site usage. You can control cookies in your browser; essential cookies are required for login and session.

2.3 Information From Third Parties

  • Payments/Fraud: Payment processors and anti-fraud vendors.
  • Vendors/Partners: Datacenter and connectivity providers related to your Services.
  • Public/Registry: WHOIS, IRR, and RPKI data to validate routing and LOAs.

3. How We Use Information

We use information to: (a) provide, operate, provision, secure, and bill the Services; (b) process transactions and account changes; (c) communicate non-marketing messages (service, security, legal, support); (d) prevent, detect, investigate, and mitigate fraud, abuse, security incidents, and violations of our Terms and AUP; (e) maintain and improve the Site and Services, conduct quality assurance, and plan capacity; (f) comply with law, enforce agreements, and protect rights, safety, and property; and (g) if enabled, send optional product updates or promotions (you may opt out at any time).


4. Disclosures of Information

We may disclose information to:

  • 4.1 Service Providers/Processors: Payment, billing, collections, fraud and security vendors, datacenter and network partners, customer-support tools, professional advisors, and independent auditors or consultants, who are bound by confidentiality and may use information solely to provide services to us.
  • 4.2 Legal/Compliance: If required by law, subpoena, or court order, or to protect rights, safety, and network integrity. Where not legally prohibited, we endeavor to notify affected customers before disclosing information targeted to their account.
  • 4.3 Business Transfers: In a merger, acquisition, financing, or sale of assets, subject to customary confidentiality.
  • 4.4 With Your Direction/Consent.
  • 4.5 Aggregated/De-identified Data: That cannot reasonably identify you.

We do not “sell” or “share” personal information as those terms are defined under the California Consumer Privacy Act (as amended) and similar US state privacy laws.


5. Cookies & Analytics; Do Not Track

We use necessary cookies for authentication and portal operation and may use analytics cookies to understand Site usage. You can adjust cookie settings in your browser; some features may not function without essential cookies. We currently do not respond to “Do Not Track” signals.


6. Security

We implement commercially reasonable organizational, technical, and physical measures designed to protect information. No method of transmission or storage is 100% secure. Under our self-managed model, you are responsible for securing your servers, operating systems, applications, credentials, encryption, patches, backups, access controls, and any data you host on your systems.


7. Data Retention

We retain information as long as reasonably necessary to provide the Services, meet legal and financial record-keeping obligations, resolve disputes, maintain security, and enforce agreements. Retention periods vary by data type and context.


8. International Transfers

We are headquartered in the United States and may process information in the US and other jurisdictions where we or our providers operate. Where required, we use appropriate safeguards for cross-border transfers (for example, standard contractual clauses) consistent with applicable law. Customer (as controller of its own data) is solely responsible for ensuring its data hosted on the Services complies with all international transfer requirements applicable to Customer’s business.


9. Your Choices & Rights

Access to, or exercise of, certain rights (including those mentioned in this Section 9) is subject to identity verification, applicable law, and contractual constraints. We may decline requests that are unverified, excessive, or would conflict with legal or record-keeping obligations. Nothing in this Policy limits non-waivable rights under applicable law.

9.1 Marketing: You can opt out of promotional emails at any time; we will still send transactional or service communications.

9.2 Requests: Subject to verification and applicable law, you may request access to, correction of, deletion of, or portability or restriction for personal information by contacting Legal@eqservers.com. We will respond within legally required timeframes.

9.3 Authorized Agents: Where permitted, we may require proof of authorization and identity verification.


10. EEA/UK (If Applicable)

Where we act as a controller for EEA/UK data subjects, lawful bases typically include performance of a contract, legitimate interests (for example, security and billing), legal obligations, or consent (if used). Rights under GDPR and UK GDPR (access, rectification, erasure, restriction, objection, portability) may be exercised via Legal@eqservers.com. Where we act as a processor for a customer, we process personal data under that customer’s instructions and relevant agreements.


11. Children’s Privacy

The Site and Services are not directed to children under 13. We do not knowingly collect personal information from children under 13.


12. Third-Party Sites/Services

Third-party websites or services linked from our Site are governed by their own policies.


13. Changes; Contact; Governing Law

13.1 Changes: We may update this Policy from time to time. Material changes will be posted with a new “Effective Date.” Your continued use of the Site or Services after the effective date constitutes acceptance of the updated Policy.
